These terms and conditions apply to all orders that you place with us. Please make sure that you read these conditions carefully. If you have any questions, please email us at buniol.tomatoes@gmail.com.
Guarantee
All Buniol products should reach you in perfect condition. If anything you receive from us is damaged on arrival, please get in touch with us within 14 days via buniol.tomatoes@gmail.com, and we will find a solution.
Order Dispatch
Tomato Seeds. We package and dispatch throughout the day and guarantee that any orders paid before 13:00 on a weekday will be dispatched the same day.
Tomato Seedlings. We package and dispatch the plants starting the 1st of May to make sure the delivery process is free of any risk of frost, mainly at the place of destination.
Art Prints. Please note that our art prints are made on demand. We will pack your order as soon as possible. We aim to dispatch your order within 3 days of your order being placed. However, please note that sometimes it can take 1-2 days extra due to delays in the carrier, bank holidays or if we have an unusually high volume of orders.
Please note that delivery times vary by country and, in some cases, must be checked by customs first upon importation.
Delivery
Your shopping basket displays the products you have purchased.
The delivery time depends on the service and products selected and the time of year.
Tomato Seeds. Once your seeds order is dispatched, we are all in the hands of the postal services. On average, from dispatch, this will be 7-9 weekdays for our economy mail service. You will receive a dispatch notification by email as soon as your order is shipped.
Tomato Seedlings. Once your seedlings order is dispatched, it will arrive at the place of destination in 2 working days, as we offer delivery via airplane. Hence, it is essential to ensure that someone is there to receive the package on the day of delivery. You will receive a dispatch notification by email as soon as your order is shipped.
Art Prints. Delivery is normally within 9-14 business days maximum from the order date.
If you haven’t received your order within the delivery time advertised, please first check if you have provided us with the correct information. If you have provided the right information, contact us at buniol.tomatoes@gmail.com no longer than 30 working days after the order was placed, and we will help you.
All estimates are from the time payment is cleared.
Postage and Packaging
Postage and packaging charges are applied at checkout and clearly stated.
Payment
Payment for our products is due when the order is placed. We accept payment for online orders by Visa and Mastercard. Cards are debited when the order is first processed to avoid issues where credit & debit cards may expire before the delivery date. Just provide your card type and number, expiry date, and the three-digit security code, which can be found on the back of the card.
Prices
Prices include VAT where applicable. We reserve the right to revise any costs in the event of unforeseen circumstances or changes in the VAT rate.
Availability
We will endeavor only to offer products that we expect to have in stock and available for ordering, but all items are subject to availability. Occasionally, items become unobtainable due to crop failure, high demand, or other reasons.
Varieties that become unavailable will not be selectable on our website. Should a specific variety not be available at the time of dispatch, or if items are of improper quality to send, we will contact you and either fully refund the item or offer you the option of the closest alternative.
Use of site
Product Images are as a visual guide and representation only. If you wish to use one of our images, you must obtain permission first. You may view or print specific pages from this site for your own personal use only but not copy, reproduce, modify or distribute any part of this site without our written permission.
Conditions of Sale
Information given about our products is to the best of our ability and is for general guidance only. All capacities are approximate.
Seed Quality
Please note that seeds and seedlings are live products that depend on many essential related grower skills such as proper planting time, seed depth, type of soil, watering, proper use of fertilizers, weed controls, fungicides, insecticides, disease-free soil, and reasonable weather conditions during the growing period.
Germination is affected by such factors as temperature, moisture content, light intensity, and contamination of planting media. Although we do everything possible to get seeds to you in the best possible condition and will provide as much help as possible, these factors are totally outside our control, and once you receive the seeds, it’s over to you. The same is valid for our tomato seedlings.
Consequently, we can take no responsibility for the suitability to your local conditions of any variety offered, the indicative cultivation advice provided, or, ultimately, the variety’s performance. As such, you should seek local advice to carefully ensure your local conditions and the time of season are appropriate to the variety purchased.
Seedlings Quality
All our seedlings are obtained from fermented tomato seeds collected from our sustainably grown tomatoes. They are grown in lower temperatures than normal for a better rate of success when replanted in the final site and, as a consequence, the plants may seem smaller than other seedlings available on the market. For the best outcomes the plants should be handled with care and with mindfulness for the planting conditions required.

Right to Cancel
You have the right to cancel your seeds order and art print order at any time up to 14 days after receipt.
If you wish to cancel an order, please contact us via buniol.tomatoes@gmail.com.
You must take reasonable care of goods while in your possession. We reserve the right to cancel any order. You will receive a refund as soon as possible and within 30 days of cancellation. Unless the goods are defective, damaged, or not as specified on your order acknowledgment, you are responsible for the carriage cost.
Changes to an order. If you wish to change your order, you must email us promptly before the order is dispatched, and we will do our best to implement the change where possible.
We are not compelled to accept any change, but, if we do, we will be entitled to recover from you any unavoidable losses that we suffer as a result of the change and to alter the delivery date and the price as a condition of accepting the change.
Privacy and Data Protection
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully. We may use cookies to assemble your order, but they contain no personal information.
When you order, we need to know your name, email address, invoice and delivery address, payment details, credit or debit card number details, and other information as appropriate. This information enables us to process and fulfill your orders and notify you in the event of any queries.
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies, we will delete or correct them promptly. If you have any questions/comments about privacy, you should contact us.
We never store or retain any details of your payment cards.
Liability
We warrant that the seeds and seedlings supplied shall be of the species and type specified in the contract.
We are not liable if you have damaged the items through your own activity or utilised different instructions than that provided on the item listing page.
We have no liability for death or personal injury caused by carelessness.
We are not responsible for the site’s accuracy, although every effort has been made to ensure that the information contained is correct and up to date. We do not guarantee that this site will operate free of error or that it is free from computer viruses or any other contaminating computer programs. We will not be liable to you or in breach of contract for delay or failure to perform due to any causes beyond the reasonable control of us or our suppliers, including but not limited to acts of God, civil commotion, industrial dispute, riots, flood, and legislation. Liability shall be limited to the cost price paid for the item.
Changes to the Terms
We reserve the right at any time to remove, modify or change without notice any information on this site. We may also change these terms at any time. If you use the site after any changes have been made, you will be bound by the new terms. You should therefore ensure that you read the terms each time you use the site.
